This terms of use agreement (hereinafter referred to as the ‘Agreement’) along with the privacy policy governs the use of this website (web address) (hereinafter referred to as ‘the website’) and all purchases made by the visitors (hereinafter referred to as ‘you’ or ‘user’) from this website. The services and information offered on this website are available to you conditionally on your acceptance, without modification, of the terms enumerated in these terms of use agreements. If you disagree with any of the terms and conditions enumerated in this terms of use agreement, you must not use the website or avail of any of the services provided herein.

In this instance, if you decide to register on the website, you will be made to expressly agree to the terms of use agreement. Renaissance Group Dandeli reserves the right to deny registration of any user if the user does not expressly assent to the terms of use agreement.

Dandeli Resorts by KaliTide Adv Ltd. reserves the right to change or revise these terms of use agreement on this website. The changed/revised agreement shall be effective immediately after being posted on the website. Your use of the website after such revision or changes shall imply your acceptance of the changed/revised agreement.

This website offers information and marketing materials provided directly by us or through third-party sources. The website also allows you to purchase various packages for various trips and adventure activities organized by Dandeli Resorts by KaliTide Adv Ltd.

The content provided by us on the website is the exclusive property of Dandeli Resorts by KaliTide Adv Ltd. and is protected by copyright, trademark, and other laws as applicable in India. You, hereby acknowledge the content to be the intellectual property of KaliTide Adventures and are restrained from removing, changing, or altering the same.

You are hereby licensed to view the pages on a web browser. However, the license extends to your personal or official use of the website alone. Unless permitted expressly you may not republish, reproduce or redistribute the contents and services provided on the website or show or exploit the material provided on the website in public.

BOOKING AND PAYMENTS

The packages made available by Dandeli Resorts by KaliTide Adv Ltd. on the website are offered on an ‘as is’ and ‘as available basis. No modification or concessions can be made to the packages without the express consent of KaliTide. Furthermore, KaliTide gives no guarantees or warranties for the reliability, suitability, or punctuality of the services provided under the packages opted by you through the website. The same is subjected to adjustments and modifications depending on circumstances, including but not limited to, Acts of God, Road Blockages, delayed arrival, accidents, and other circumstances beyond the control of KaliTide Adventures. Any extra cost that may arise due to the above-mentioned circumstances shall be borne by the user alone.

It is the duty of the user to verify and confirm that the contents of the website and the packages provided on the website meet the specific requirements of the user. Furthermore, it is the duty of the user to verify the itinerary provided for the specific package provided by Dandeli Resorts by KaliTide Adv Ltd.

The packages availed by the user shall be confirmed only after the payment of the complete cost of packages. The website provides various payment methods through third-party gateways for the convenience of the users. The user shall avail of these mediums for payment at their own risk. Dandeli Resorts by KaliTide Adv Ltd. takes no responsibility for the risks and damages that may occur to the user by making use of these payment gateways.

CANCELLATION

If the user wishes to cancel any booking due to any reason whatsoever, the same shall be only valid if Dandeli Resorts by KaliTide Adv Ltd. is notified of the cancellation in writing at its official address, at least 15 days before the commencement of the trip or adventure activity. Any refund due to the user by Dandeli Resorts by KaliTide Adv Ltd. shall be subject to cancellation charges.

Written cancellations will only be acknowledged if they are received by Dandeli Resorts by KaliTide Adv Ltd. at their official address on working days. Cancellation requests received on Sundays and public holidays shall be processed only on the next official working day.

REFUNDS

The following refund shall be payable to the user in case of valid cancellation of a booking:

• If the cancellation request is received within 30 to 45 days from the commencement of the trip or package, 50% of the advance payment shall be refunded.
• If the cancellation request is received between 15 to 30 days from the commencement of the trip or package, 25% of the advance payment shall be refunded.
• In cases where the cancellation request is not received before 15 days from the commencement of the trip, Dandeli Resorts by KaliTide Adv Ltd. shall not be liable to pay any refund.

Cancellation for booking made within 15 days of departure date will not be liable for any refund.

The above-mentioned refunds are subjected to deductions for any expenses that may have been incurred for resort booking/reservations or transport etc, by Dandeli Resorts by KaliTide Adv Ltd.

In cases where the request for cancellation is received after the commencement of the trip or if the user voluntarily drops out of the trip for any reason whatsoever, Dandeli Resorts by KaliTide Adv Ltd. shall not be liable to pay any refund. Furthermore, no refund shall be payable by KaliTide for any of the services or facilities provided by Dandeli Resorts by KaliTide Adv Ltd. in its packages, but not availed by the user.

RESPONSIBILITY OF THE USER

It is the duty of the user to verify the dates, availability, and itinerary of his/her travels for the trips organized by Dandeli Resorts by KaliTide Adv Ltd.

The adventure activities are designed to push the human body to its absolute limit and hence are full of hazardous and strenuous conditions and circumstances. Reasonable mental and physical fitness is imperative for a comprehensively enjoyable experience on the adventure activity. Fitness manuals are provided on the website which provides a detailed fitness plan for various adventure activities the user may wish to undertake so that you can prepare for the activity accordingly.

Furthermore, it is the responsibility of the user to assess his fitness level and check the suitability of the adventure activity he wishes to undertake. Dandeli Resorts by KaliTide Adv Ltd. will not be responsible if the user finds the watersports or the adventure activity to be beyond his physical and mental capabilities. If you suffer from any ailments and disabilities, that may hinder your enjoyment of the activity or which may pose risks when subjected to extreme conditions during the adventure activity, it shall be your sole responsibility to get proper medical checkups and opinions. Furthermore, if any precautions or measures are to be undertaken for your health and safety it is the sole responsibility of the user alone. Dandeli Resorts by KaliTide Adv Ltd. shall not be liable for any harm or damage that may befall you because of your inadequate physical, mental, and medical preparation for the adventure activity.

While undertaking a trip the luggage and personal effects are the sole responsibility of the user and the user will carry them at their own risk.

When on the trip the users are required to behave in a manner acceptable and conducive to group travel. The user shall refrain from acting in any manner which may be socially or morally unacceptable and which may cause annoyance or discomfort for fellow travelers or may endanger their life, person, or possession. Dandeli Resorts by KaliTide Adv Ltd. reserves the right to terminate the adventure activity, without refund, of any user who may act in the manner aforesaid mentioned.

PHOTOGRAPH RELEASE

Dandeli Resorts by KaliTide Adv Ltd. reserves its right to take photographs of you during your participation in an adventure activity organized by Dandeli Resorts by KaliTide Adv Ltd. and to edit, alter, copy, exhibit, and use the same, in whole or in part, in any form and manner, through any medium, in print, internet, and social media, for promotion, publicity, advertisements, illustrations, and web content. You hereby waive any and all rights to the photographs taken of you during the adventure activity and release and indemnify Dandeli Resorts by KaliTide Adv Ltd., its directors, partners, agents, and servants from all claims, demands, and actions that may arise because of the use of those photographs.

DISCLAIMER AND WARRANTIES

Dandeli Resorts by KaliTide Adv Ltd. takes utmost care that the content and the services provided on the website are accurate, however, some inaccuracies or deficiencies in the content and the services may occur. The information and the packages provided on the website may be availed by the user at his own risk. KaliTide herein disclaims all warranties of any kind, express or implied, on the accuracy, veracity, and suitability of the information and the services provided on this website. You hereby acknowledge that the information and services provided on this website may contain inaccuracies, deficiencies, and errors.

LIMITATION OF LIABILITY

The extent of liability, and the extent of remedy, with respect to the contents of the website and the services provided herein, or any breach of agreement shall be limited to the extent of the amount paid by the user for the information of service provided. To the extent of contents and information that is provided free of charge on this website, Dandeli Resorts by KaliTide Adv Ltd. will not be liable for any loss or damage arising out of that.

Dandeli Resorts by KaliTide Adv Ltd. shall not be liable for any loss or damage arising directly or incidentally from the use of the website, its contents, or the packages provided on the website, or any loss suffered by the user in payments made through the website.

It is imperative that the user assent to the participation form/waiver of rights/indemnity bond by affixing their signature before undertaking the adventure activity provided through this website by Dandeli Resorts by KaliTide Adv Ltd. Dandeli Resorts by KaliTide Adv Ltd. reserves the right to refuse the user from participation in the adventure activity if the user refuses to assent to the participation form/waiver of rights/indemnity bond and KaliTide shall not be liable to make any refund for the same.

INDEMNITY

You hereby release, indemnify and hold harmless Dandeli Resorts by KaliTide Adv Ltd. and any of its directors, partners, officers, shareholders servants, and agents from all liability, claims, damages cost, and expenses, arising from breach of any obligations or warranties provided under this agreement, or from the use of the information, services, and packages provided on the website.
